Terms & Conditions

1. Contract of Hire

All bookings are accepted by Rentmojacar Property Management and are subject to these conditions which are deemed to have been accepted in full by the hirer and all persons in the party. Bookings can be made by fax, e-mail or through the website and would be deemed to be accepted once payment is received by us.

2. Deposit 

A non-refundable deposit of 30% of the total cost is required to secure your booking. Your booking must be made by e-mail, through the website or by telephone (followed by written confirmation) and will be held provisionally for five days. If your deposit has not been received within this period the provisional booking will be released. The remaining 70% is payable 8 weeks before travel. If your booking is made eight weeks or less before the rental start payment must be made in full.

Long term rentals are secured with a deposit payment equivalent to one months rent and will be retained as a bond for the duration of the rental. Long term rentals are subject to a contract fee of 50€. Long term rentals will arrive during office hours.

3. Confirmation of Booking 

Your booking is only confirmed on receipt of your deposit and confirmation will be sent to you by email. A reminder e-mail for the final balance will be sent approximately 10 weeks prior to travel.

4. Final Payment 

The balance will be paid a clear eight weeks prior to the hire commencement date by credit card. This service does incur a credit card handling fee. If your booking is made eight weeks or less before the hire commencement date it will be deemed provisional for five days or until full payment is received, whichever is the sooner. If we do not receive the balance by the seventh week prior to your rental commencement date, we shall be entitled to cancel the booking without prejudice.

5. Form of Payment

All payments prior to your arrival date shall be paid by credit card. Payments made during the property hire period shall be paid in cash in Euros. Payments due to you by Rent Mojacar Property Management, e.g. refund of the damage waiver/long term rental bonds will be refunded to you by bank transfer.

6. Cancellation by Hirer

All cancellations of bookings must be in writing by post and notified to and received by Rent Mojacar Property Management no later than eight clear weeks prior to the rental commencement date. Cancellation will become effective from the date we receive it in writing. Deposits are non-refundable eight weeks or more prior to the rental commencement date. The total cost paid eight weeks or less prior to the rental commencement date are non-refundable therefore it is a condition of booking that insurance is taken out well in advance against cancellation.

7. Alterations and Cancellations by Us

In the unlikely event that a property becomes unavailable due to circumstances beyond the control of Rent Mojacar Property Management, the hirer will be offered alternative accommodation or a full refund. In the event that no suitable accommodation can be offered then a full refund of the villa rental will be made. Any refund is restricted to the property hire costs and we are not liable for any cancellation or administration charges for travel arrangements, etc.

8. Amendment Charges

In the event you wish to alter details of a fully confirmed booking within the eight week period, there will be an administration charge of £25 per change in addition to any increase, if any, in the cost of the revised arrangement. Confirmation of the amendments must be sent by you to Rent Mojacar Property Management in writing or by email.

9. What is Included

Holiday rentals include the cost of linen and towels, water, electricity, gas, maintenance of swimming pool and garden. Any defects or deficiencies must be reported within 48 hours of your arrival. After this time it will be assumed that everything is in order.

Long term rentals do not include the cost of laundry or cleaning. On departure long term rentals will be left in the same condition as on arrival, i.e. towels & linen laundered, property cleaned. Long term rentals are subject to additional charges for utilities.

10. What is Not Included 

The property rental prices do not include personal, travel and cancellation insurance, travel, transportation, airport transfers, full resort representation or mid-stay cleaning of the property.

11. Occupancy

Rental parties must not exceed the maximum occupancy figures listed on the website. The property cannot be re-let or sublet to any other group/party or individual without the written approval of the owners. Under no circumstances may more than the maximum number of persons specified in the property description, or booking form, occupy the property except by prior written agreement. Rent Mojacar Property Management, or their representatives, reserves the right to refuse admittance to the villa to the hirer and their party if they are in breach of this condition. Generally we do not accept animals to any of our properties. However, there may be certain exceptions, please enquire. In such cases you must obtain permission from Rent Mojacar Property Management.

12. Hirer's Responsibility

The hirer is responsible for taking all reasonable care of the property and its contents. At the end of the hire period, the property and its contents, including all equipment, furniture, utensils, etc must be clean and tidy which includes the crockery and cutlery cleaned and stored in the appropriate cupboards and ensure that the cooker, oven, fridge and microwave are clean. The hirer shall ensure that no member of the party engages in any activity in or around the property and or swimming pool which may cause damage, offence to the neighbours, pollution to the water or damage to the structure or filtration equipment, this includes unacceptable anti-social behaviour. The hirer shall also ensure that the barbeque is cleaned and that all rubbish is cleared away from the property and placed in the communal dustbins.

13. Damage to Property and its Contents

The hirer will be responsible for making good any damage to the property or its contents, except in the case of normal wear and tear, which has occurred due to negligence, willful damage or irresponsible behaviour on the part of those occupying the property or their guests. Such damage must be immediately reported to Rent Mojacar Property Management. The costs of the replacement or damage will be deducted from the damages deposit. A credit card deposit of €200 is held against damage to the property, furnishings or excessive cleaning requirements, including those outlined in Section 12. above.

14. Right of Access

Rentmojacar Property Management, their representatives or their sub-contractors have the right of access to the property at any time with due regard to the convenience of the hirer for the purpose of linen changes, inspection of the property and to carry out any essential or routine repair or maintenance work.

15. Responsibilities

Neither Rentmojacar Property Management or their representatives can be held responsible for any circumstances beyond their control including, but not limited to, mechanical breakdown, illness, emptying of the swimming pool for necessary maintenance, closure of the swimming pools by communities/ complexes or failure of any public service supply. The hirer responsible for booking undertakes that no person will suffer anything to be done which would endanger the policy of the property owner's insurers in respect of the villa and its contents which might make the same void or voidable.

16. Injury and Damage

Rentmojacar Property Management acts as a booking agent on behalf of the owners of the properties we offer and, as such, your contract is with the owner. We do not have any responsibility to compensate you for any personal injury, illness, death, loss or damage of whatever nature suffered by you, or any member of your party, during the booking period or thereafter.

17. Accuracy of Information

We always take a great deal of care to make sure that the information and photography contained in this website to the best of our knowledge is correct. However all our properties are privately-owned and therefore from time to time owners may make changes in their homes to details like decoration, furniture and fittings. All information supplied by Rentmojacar Property Management is given in good faith and is based upon information available at the time. All reasonable measures have been taken to ensure accuracy, but Rentmojacar Property Management and their representatives are not liable for any variation however caused.

18. Property Arrival and Departure Times

Holiday Rentals
Arrival time 2pm Departure time 10am 
(all arrivals outside office hours will be charged a late arrival fee of 25€) 
Late holiday accommodation departures can be accommodated in some instances. Please contact our office for further information.

Long term rentals
All arrivals must be on a weekday within office hours. Long term checkouts must be on a weekday within office hours. Out of hours arrivals/departures can be accommodated at an additional charge. Out of hours checkouts will be completed on the first working day by a Rentmojacar representative, with bonds refunded by transfer.

19. Keys, Directions and Local Contact Numbers.

Detailed instructions for key collection and directions to the property will be sent immediately after receipt of the final payment, together with a local contact telephone number should you have any problems whilst at the property. Out of hours arrivals will be charged a standard Meet & Greet Fee of 25€.

20. Complaints

In the unlikely event that you have a complaint about the property or its contents whilst on holiday, it must be reported immediately to Rentmojacar Property Management or its representatives who will take reasonable steps to resolve the matter. Neither Rentmojacar Property Management or its representatives shall have any liability for any complaint submitted after the completion of the hire period.

21. Building Work

In the event of building works taking place by local authorities, private developers or neighbours, it is important to note that we are not responsible for such work, are unable to stop such work taking place or unable to control the level of noise, neither can we be responsible for any building works that start during a holiday.

22. Force Majeur

We regret we cannot accept liability or pay any compensation where the performance or prompt performance of our contractual obligations is prevented or affected by 'force majeur'. In these Terms and Conditions of hire, 'force majeur' means any event which we or the supplier of the service(s) in question could not, even with due care, foresee or avoid. Such events may include, but are not limited to, war, threat of war, civil commotion or strife, hostilities, strikes or other industrial disputes, natural disasters, fire, acts of God, terrorists activities, quarantine, epidemics, weather conditions, government action or other events outside our control.

23. Laws and Jurisdiction

This agreement shall be governed by the Laws of Spain to which both parties expressly submit.

24. Insurance

The villa hire does not include any person insurance cover of any kind. It is a condition of booking that insurance is taken out against cancellation and it is strongly recommended that personal accident and medical insurance is also taken out.
